The Policy Was The Easier Half

On July 1, Ohio becomes the first state in the country to require every public K-12 district to have a formal artificial intelligence policy in place. House Bill 96 turned what had been friendly guidance in most states into a statutory duty. Districts have had six months to adopt the state's model verbatim, adapt it, or write their own. The compliance line is real. The harder question, quietly underneath it, is what any district can actually see once the policy is signed.

On July 1, Ohio becomes the first state in the country to require every public K-12 district, community school, and STEM school to have a formal policy on the use of artificial intelligence.1 The requirement, buried in House Bill 96, the state's biennial budget, turned what had been friendly guidance in most states into a statutory duty.2 The Ohio Department of Education and Workforce was directed to publish a model policy by the end of last December, and did so in early January; districts have had six months to adopt the model verbatim, adapt it, or write their own.3 Columbus City Schools, the largest district in the state, passed theirs unanimously in late March after months of collaboration with about fifty stakeholders.4

The policies that landed on desks this morning share a family resemblance. They set expectations for academic integrity and citation. They align data handling with FERPA. They require disclosure when AI is used in student work. They insist on transparency with parents and training for staff. They cover procurement, bias, accessibility, and consequences.5 They are, as first drafts go, careful and thoughtful documents. They are also, if you spend an afternoon reading them, almost impossible to verify from the outside.

What A Policy Can And Cannot Do

A policy is the way a building tells itself out loud what it plans to do. It matters. In a year in which ninety-two percent of students and educators are already using AI, and most report no formal training, the fact that Ohio has stopped waiting is a real thing.6 It says the district has considered the question. It says the school board has taken a position. It gives a teacher who wants to allow the tool a sentence to stand on when she does, and a teacher who wants to say no a sentence to stand on when she does. That is not nothing.

But a policy is a sentence. A classroom is a Tuesday. The policy that says students must disclose AI use does not, by itself, tell the teacher on Tuesday which sentences in the essay in front of her were the student's, which were the model's, and which were the student's after a conversation with the model. The policy that says only district-approved tools may be used does not, by itself, tell the principal which unapproved chatbot his ninth graders were using at lunch. The policy that promises transparency to parents does not, on its own, produce anything for a parent to see.

This is the quieter half of the compliance day. The half where a superintendent looks at her signed resolution and asks a plain question. If I were audited tomorrow on my own policy, what would I actually show?

Policy Without A Look

The distance between a rule and a record is how a school district loses trust. It is why so many honor codes drift into ritual. It is why so many acceptable use policies live in a binder that no one has opened since orientation. A rule that no one can see followed is a rule that becomes a mood, then a memory. In every previous wave of school technology, we have watched this happen. Filtering policies became keyword lists. Screen time policies became stopwatches. The policy asks the question in language the room can approve of. What the room actually does with the tool, in the minutes, is another matter.

The next year of AI policy in Ohio, and in the ten or fifteen states that will follow, will not be won at the board meeting. It will be won or lost in whether the classroom can look inside its own days. Whether, when a policy says students must disclose AI use, a teacher can actually see the shape of the student's process next to the finished draft. Whether the pauses and revisions and prompts are visible in a way that a rule can attach to. Whether the transparency to parents clause is more than a promise. A rule without a look becomes a wish. A rule that a teacher can see whether or not is being followed, on Tuesday, in the essay in front of her, becomes a practice.

What The Deadline Is Really For

Ohio's July 1 date is, in the strict sense, a compliance line. Every district has adopted a policy, or is late.1 But the more useful way to read the date is as a starting line. The state has said, out loud, what it wants to be true about AI in its classrooms. The interesting question now is who can actually see whether it is true.

A district that adopts the model policy and moves on will have earned an inch of political cover and no new insight. A district that treats today as the beginning of the harder half, the half where the room learns to see the work, is doing something else. It is trying to close the gap between a promise and a Tuesday morning.
